Coverage
The MIEC policy covers acupuncturists for health care services to your
patients as defined in Business and Professions Code Sections 4927 and 4937. The policy gives you two choices of liability limits
- $500,000 per claim/$1.5-million annual aggregate, or
- $1-million per claim/$3-million annual aggregate.
The policy also provides for legal defense costs in addition to the limit of liability, and a
$25,000 reimbursement for legal defense costs incurred as a result of licensing agency proceedings involving quality of care issues.
This acupuncture purchasing group program contract is provided under a claims-made policy, meaning that you are protected for claims that occur and are reported to MIEC during the time you are insured with MIEC. If you come to MIEC from another claims-made carrier, we offer prior acts coverage. This will cover you for claims first made against you in the future, but related to treatment that occurred while you were insured under the previous claims-made policy.
MIEC also offers tail coverage, which may be purchased if your MIEC policy is canceled or not renewed for any reason. Tail coverage will allow you to report otherwise covered claims after the cancellation or non-renewal date. The cost of tail coverage is calculated when the policy is canceled or not renewed. We will provide tail coverage at no additional cost to you when you retire from practice at age 55 or more (so long as you have been insured with MIEC for at least five consecutive years). MIEC also provides free tail coverage in the event of total disability or death at any time while an MIEC insured.
IMPORTANT: If your most recent coverage was a claims-made policy, you must either purchase tail coverage from your former carrier or apply for prior acts (also called nose) coverage with MIEC. Prior acts coverage is generally available if you are currently insured under a claims-made policy in a state where MIEC provides professional liability insurance. If MIEC approves you for prior acts coverage, MIEC premiums will be at the claims-made step-rate based on the number of years you have been insured by your previous claims-made carrier.
Premises liability coverage is available at no cost for professional office
locations that you own or lease (not home offices). It insures your legal
liability for injuries to patients or members of the public sustained at
your office premises, such as a slip and fall claim. The coverage does not
insure any personal property you own or lease
