Physicians
Medical Malpractice Coverage
We cover individual physicians, physician groups, and facilities in California, Hawaii, Idaho and Alaska. Additionally, we offer policy limits up to $5 million for each claim/$7 million annual aggregate.
The costs of defending you against claims are in addition to these limits i.e. the cost of defending you does not reduce your coverage. Higher limits may be available for individual physicians for physician group entities. Contact us for more details and a quote.
Our policy features
We cover you for allegations of damage or injury resulting either from the delivery, or alleged failure to deliver, health care services to patients. Our policy form also affords you coverage when acting as an independent medical examiner and when providing advice or consultation regarding the health of persons who are not patients. Perhaps most importantly, our policies contain a “consent to settle” clause that means we cannot and will not settle a claim against you without your consent.
Defense Coverage for Specified Practice Risks
We offer our policyholders up to $25,000 in legal defense coverage for administrative proceedings or civil lawsuits by the office of the Inspector General; or non-employee claims arising from your practice that allege:
- Unlawful discrimination
- Harassment
- Assault and battery
- Malicious prosecution
Cyber Liability Insurance
For policies issued after January 1st, 2025, MIEC is changing its approach to cyber liability coverage for eligible MIEC members. In collaboration with its longtime reinsurance partner Tokio Marine HCC—Cyber & Professional Lines Group, MIEC will issue cyber liability insurance coverage through a Master Policy written by Tokio Marine HCC.
As a healthcare practitioner in an age of rapidly evolving technology, storing sensitive data has become ubiquitous in the delivery of healthcare. As a result, the threat of breach continues to evolve, exposing practitioners to potential liability. Coverage under the TMHCC master policy provides eligible MIEC policyholders Basic Limits of $50,000 in annual aggregate coverage, subject to the Master Policy aggregate limit.*
Additional coverage is available via a separate policy, subject to Tokio Marine HCC underwriting review and approval.
* Master Policy Annual Aggregate Limit: This is a Master Policy written by Tokio Marine HCC, which provides coverage subject to an annual aggregate limit, which is shared by ALL insureds on the policy.

MIEC provides an electronic platform for information that will enable you to understand and deal with these new and evolving exposures. This includes unlimited online access to tools and resources that help mitigate your exposure if a breach occurs, such as:
- Compliance materials with state-by-state rules and regulations
- Implementation checklists to help protect, detect, contact, and correct any security violations
- Training programs such as webinars, bulletins, and online modules for you and your staff
- Step-by-step procedures to reduce risk including information on the proper destruction of protected health information
Optional Coverage
Prior Acts (Nose) Coverage
Prior Acts Coverage is available to physicians applying for coverage after being continuously insured by another claims-made insurer and eliminates the need to purchase reporting endorsement (tail) from your previous insurer. This coverage is subject to approval by our underwriters.
Miscellaneous Business Liability (optional defense coverage)
We offer at an additional cost, legal defense protection, which pays 90% of reasonable legal expenses, up to $100,000 per civil suit or administrative proceeding, with a maximum of $300,000 for all claims reported during a policy year for the following:
- Breach of contract
- Wrongful termination of an employee
- Employment discrimination or harassment
- Wrongful acts or omissions
- Civil claims for assault, battery, false arrest or personal restraint, malicious prosecution or conspiracy
Premises Liability
We can also provide coverage for premises liability, which insures the liability that arises from bodily injury and property damage to members of the public at your professional office premises. This coverage is optional and it does not constitute comprehensive general, business, automobile liability or workers compensation coverage.
Extended Reporting Endorsement (Tail) Coverage
Offered to any policyholder whose policy is canceled or not renewed, tail coverage extends the reporting time for covered claims beyond the life of the policy. Because most malpractice claims and suits are filed months or years after treatment or surgery, tail coverage is an important safeguard. The premium is based on rates in effect when the coverage is offered. There is no premium for policyholders who have been with us for at least five consecutive years. Tail coverage is also provided at no cost when a policyholder becomes totally disabled or dies.
Group Coverage
We provide separate entity coverage to your multi-shareholder corporation or partnership provided all physician members are insured with us. Discounts are available to groups who meet certain premium and size criteria or who participate in our sponsored loss prevention program.
